Trump Administration Asks High Court Permission to Fire Leading Copyright Official

The ex- leader's administration on Monday requested the nation's highest court to permit the termination of the director of the American copyright authority.

This urgent request follows about a month and a half after a federal appellate court in Washington decided that the official, Shira Perlmutter, cannot be unilaterally dismissed.

Nearly one month prior, the full District of Columbia appeals court declined to review that decision.

This legal matter is the latest in a series of cases concerning presidential authority to appoint preferred leaders at government offices.

The Supreme Court has mostly allowed such actions, even as court disputes continue.

However, this particular case involves an office inside the Library of Congress. Perlmutter serves as the register of copyrights and also advises Congress on intellectual property issues.

The solicitor general, D John Sauer, stated in the filing that, despite ties to Congress, the director “exercises administrative power” in regulating intellectual property rights.

Perlmutter alleges she was fired in May because the ex-leader disagreed with recommendations she gave to lawmakers in a document related to artificial intelligence.

She reportedly received an message from the administration informing her that her position was “terminated starting immediately,” according to her staff.

A split appeals court group ruled that Perlmutter could retain her position while the case moves forward.

“The Executive's alleged blatant meddling with the work of a Legislative Branch official, as she carries out statutorily approved responsibilities to counsel the legislature, appears to be a breach of the separation of powers,” stated Justice Florence Pan for the appellate panel.

Judge J Michelle Childs supported the opinion. Both justices were nominated to the appeals court by Democratic President Joe Biden.

In opposition, Judge Justin Walker, a former president's nominee, wrote that Perlmutter “exercises administrative power in a host of manners.”

Perlmutter's lawyers have argued that she is a well-known copyright specialist. She has acted as register of copyrights since ex- head librarian Carla Hayden selected her to the role in October 2020.

The ex-leader appointed deputy attorney general Todd Blanche to succeed Hayden at the Library of Congress. The White House had fired Hayden amid criticism from right-leaning groups that she was advancing a “progressive” program.
